1. Introduction

These Terms of Service ("Terms") in conjunction with our Privacy Policy and any additional terms we reference (together, the "Agreement") govern your use of our website and services located at sendlush.com (collectively, the "Service").

The Agreement is between Walenet ("Company", "we", "our", "us") and you ("you" or the "User").

By creating an account, using the Service, or purchasing a plan, you agree to be bound by this Agreement. If you do not agree, you may not use the Service.

2. Communications

By creating an account, you may receive service-related emails (e.g., billing, security, or product updates). Where required by law, marketing emails will be sent only with appropriate consent. You can opt out of marketing communications using the unsubscribe link or by contacting us.

3. Purchases & Payments

If you purchase a paid plan ("Purchase"), you may need to provide payment and billing information. You represent that you are authorized to use the payment method and that your information is accurate.

We use third-party payment processors to handle payments. Our current payment processor is Dodo Payments. Their privacy policy is available at https://dodopayments.com/privacy-policy.

We may refuse or cancel orders in cases of suspected fraud, errors, or other legitimate reasons.

4. Promotions

Contests, sweepstakes, or promotions ("Promotions") may have additional rules. If Promotion rules conflict with these Terms, the Promotion rules will apply.

5. Subscriptions

Some parts of the Service are billed on a subscription basis ("Subscription"). Subscriptions renew automatically unless cancelled before the end of the billing cycle. You can cancel renewal through your account (if available) or by contacting support.

If automatic billing fails, we may issue an invoice and request manual payment by a stated deadline.

6. Free Tier / Free Trial

We may offer a free tier or a free trial. Free tiers and trials may include limits and may be modified or discontinued at any time. If you provide billing details for a trial, you may be charged when the trial ends unless you cancel before the end of the trial.

8. Refunds

9. Content, Messaging, and Your Data

The Service may allow you to send messages through APIs and tools ("Message Content"). You are responsible for Message Content and any data you provide or upload ("Your Data"), including compliance with applicable laws (e.g., anti-spam laws and privacy rules).

You confirm you have all necessary rights and consents to send messages and process recipient data. You grant us a limited license to process Message Content and Your Data solely to provide the Service (e.g., transmit and deliver messages), subject to our Privacy Policy and legal requirements.

We may monitor, block, or refuse delivery of content that violates these Terms, our policies, or applicable law.

10. Prohibited Uses

You may use the Service only for lawful purposes and in accordance with these Terms and our Acceptable Use Policy. You agree not to misuse the Service (e.g., attacks, unauthorized access, malware, abusive messaging).

Our Service, branding, and software are owned by Walenet and licensors. We respect intellectual property rights and will respond to valid copyright complaints. If you believe content infringes your rights, contact us.

17. Feedback

If you provide feedback or suggestions, you allow us to use it to improve the Service without restriction, to the extent permitted by law.

The Service may link to third-party sites. We are not responsible for their content or practices.

19–20. Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available" without warranties to the maximum extent allowed by law. Our liability is limited to the maximum extent permitted by law and may be capped at amounts paid for the Service in applicable situations.

21. Termination

We may suspend or terminate access to the Service for violations of these Terms or other legitimate reasons. Provisions that should survive termination (e.g., disclaimers, limitation of liability) will survive.

22. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, specifically the laws of the State of Gujarat, without regard to its conflict of law provisions.

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat, India.

23–25. Changes & Severability

We may change the Service and these Terms from time to time. If any part of these Terms is found invalid, the remaining provisions remain in effect.

26. Logo Permission

With your permission (or as agreed), we may display your company logo to reference you as a customer in marketing materials, subject to any brand guidelines you provide.

27. Acceptable Use

The Service must be used in accordance with our Acceptable Use Policy at /acceptable-use.

28. Acknowledgement

By using the Service, you acknowledge that you have read and agree to these Terms.
